Important contractual notice
This agreement applies to each Captain who accepts it in order to use the RYDZ Captain app. Publication on this website does not by itself make anyone a Captain: a person becomes a Captain only after registering, being approved by RYDZ and accepting this agreement. Its allocation of rights is subject to the real relationship, vehicle ownership, permits, insurance and applicable employment and transportation laws. If a fleet owner and the driving Captain are different parties, both must be identified to RYDZ and each gives the undertakings that apply to them.
1. Parties and appointment
This agreement is between RYDZ Technologies Limited ("RYDZ") and the verified Captain identified in the electronic or written onboarding acceptance ("Captain"). The Captain requests permission to access RYDZ's driver application and receive and perform bookings for passengers through the platform in the approved city and service categories. Approval is conditional and does not guarantee any booking volume or income.
2. Transport role and legal status
Subject to the actual facts and mandatory law, the Captain performs transportation using their own authorized vehicle or a vehicle validly made available to them by its owner. The Captain is responsible for operating the transportation service lawfully and safely; RYDZ supplies marketplace technology, customer booking and relevant payments/support services. The parties intend a non-exclusive commercial relationship unless separately agreed in writing; however, a contractual label does not override statutory employment protections or the actual relationship. No statement here authorizes transport that requires a licence, permit or operator registration that has not been obtained.
3. Onboarding and ongoing qualifications
The Captain must be at least 18 years old and provide accurate identity and contact details; valid driving licence with appropriate category; legally required public-transport permissions; vehicle registration and evidence of lawful possession; appropriate passenger transport insurance; current roadworthiness/Certificate of Fitness or equivalent where required; vehicle photos; and safety, vehicle and other information reasonably needed to verify eligibility. In the Captain app, the driving licence, insurance, Certificate of Fitness and vehicle photos are uploaded for review, and RYDZ approves, rejects or suspends the account. RYDZ may verify originals, expiry dates and status through lawful processes. Approval may be suspended when an essential document is missing, expired, forged, revoked or materially inconsistent. Notify RYDZ of a suspension, arrest affecting fitness to operate, serious crash, impairment, loss of insurance, change of vehicle or material regulatory enforcement action as legally appropriate.
4. Vehicle and service standards
Before accepting work the Captain must ensure the vehicle is roadworthy, clean, adequately maintained, insured for the actual service, has legal seating capacity, working safety equipment, functioning seatbelts and any legally required public-service markings. Do not overload or substitute an unverified driver or vehicle. Respect pickup restrictions, traffic rules, passenger rights, road-safety checks and instructions issued by competent transport authorities. The Captain is responsible for operating expenses such as fuel, lawful permits and vehicle maintenance except to the extent a written agreement with RYDZ expressly allocates a particular cost to RYDZ.
5. Offers, acceptance and trip lifecycle
The Captain may receive booking requests subject to platform matching, availability, routing and product rules. Requests are offered to nearby online Captains, ranked by distance and adjusted for each Captain's recent acceptance and cancellation record. Only accept trips the Captain reasonably expects to fulfill safely and promptly. After acceptance, proceed to the specified pickup location, keep status accurate and communicate only as reasonably necessary. Never mark a trip started before passenger boarding, completed before completion, or cancelled to avoid platform accounting. Handle destination changes through the app so the rider sees and approves any required new fare. RYDZ may change dispatch parameters after reasonable notice and with nondiscriminatory safeguards; it must not manufacture completed trips or commissions.
6. Pricing and platform commission
For rides completed through RYDZ, the platform commission is 15% of the ride fare recorded for the completed trip (the fare the rider pays, as accepted in the app). Commission is charged once per completed ride, when the Captain marks the ride complete. It is not charged on cancelled rides, and cancellation and no-show fees paid to the Captain under the Ride Cancellation and Refund Policy are passed to the Captain in full. No commission should be assessed on a fraudulent or incorrectly marked completed trip; adjustments must be auditable and disputable. A change in the commission rate will be communicated in advance and accepted as required by contract/law; historical trips retain their agreed rate.
7. Cash rides, digital payments and payouts
Commission is deducted from the Captain's RYDZ wallet balance. Where the Captain's account holds free trips, one free trip is used instead and no commission is deducted for that ride. If the wallet balance falls below zero, the Captain is taken offline and cannot receive requests until the balance is topped up. Captains top up the wallet with Airtel Money in the Captain app (currently from MWK 3,000 per top-up). When a customer pays cash directly to the Captain, the Captain must truthfully record the payment. When a rider pays from the RYDZ Wallet, the fare less commission is credited to the Captain's wallet, and RYDZ keeps a ledger of fares, commission, fees, reversals and net amounts. The Captain app does not currently offer self-service withdrawals; to withdraw an available balance, the Captain contacts RYDZ support at support@rydzmw.com. RYDZ does not promise a fixed payout day; any fee or hold that applies is explained before the payout. The Captain must not ask customers to redirect digital payments to private numbers or unlawfully charge an off-platform surcharge. The Captain can see wallet history in the app, request an itemized statement and contest errors without retaliation.
8. Rider care, non-discrimination and child safety
Treat all people with dignity and professional care. Prohibit physical or sexual contact without lawful reason and valid consent; harassment, discrimination, abusive language, exploitation, intoxicated driving, threats, dangerous driving, unauthorized passengers and deliberate route deviation. Respect accessibility requests and mobility aids subject to the vehicle's objectively documented capacity and law. Follow the Safety and Community Standards, Captain Code of Conduct and Children and Minors Policy.
9. Insurance, accidents, complaints and evidence
The Captain must maintain compulsory and applicable commercial/passenger liability cover in force and report any accident or serious incident to emergency services, authorities, insurers and RYDZ as required. Protect the passenger first; preserve evidence lawfully without obstructing police or emergency responders. RYDZ may review trip records and reasonable evidence to investigate complaints. The Captain must cooperate in good faith, be given the substance of an allegation and a reasonable opportunity to respond unless immediate safety action is needed. This agreement does not limit injured passengers' rights.
10. Driver data and account access
RYDZ handles onboarding, location, transaction, performance and safety records under the Privacy Policy. The Captain may use rider personal data solely for arranging and completing an assigned journey, complaint resolution or lawful obligation. Do not save, sell, solicit or contact former passengers for unrelated purposes; do not publish routes, phone numbers or passenger photos. Keep access credentials private and use only approved devices/accounts. Return or delete passenger data after the permitted operational purpose ends where practicable.
11. Ratings, investigations and suspensions
RYDZ may suspend access based on a material safety risk, invalid permits, reported assault, demonstrated payment abuse, fraud, repeated service failures or other objectively supportable reasons. Except where immediate action is necessary, RYDZ will notify the Captain of the general reasons, make a fair investigation, provide an opportunity to respond and give an appeal route. Evidence requests must be proportionate, secure and privacy-conscious. Pending lawful payouts will not be held indefinitely without a lawful and documented reason.
12. Taxes, records and regulatory responsibilities
Each party must comply with taxes, licensing and recordkeeping legally applicable to its own role. The Captain must issue any receipts, keep fare and tax records and register with the relevant authorities if legally required. RYDZ will supply transaction and commission records reasonably necessary for reconciliation and lawful tax compliance. Neither party guarantees the other's licensing status absent independently verified evidence.
13. Term, termination and post-termination
Access begins after approval and formal acceptance and continues until terminated. Either party may ordinarily terminate by notice consistent with this agreement and law; a Captain may stop using the platform at any time and ask for the account to be closed. Immediate restriction may be appropriate for serious safety threats, fraud, licensing invalidity or unlawful conduct. Termination does not cancel amounts lawfully due, ongoing incident investigations, data retention or rights of passengers. The Captain must stop using RYDZ marks and delete unauthorized copies of platform data.
14. Liability, governing law and acceptance
Each party is liable for losses fairly attributable to its breach, unlawful act or negligence subject to Malawi law. Nothing excludes mandatory consumer, employment or injury protections. The parties should attempt good-faith resolution via support@rydzmw.com, then may seek relief through competent institutions or courts in Malawi. The version and effective date of this agreement are shown on this page; a Captain may ask RYDZ for a copy of the version they accepted.
